Welcome to Old Domewood. Before purchasing a property here, it is important to understand the legal and ownership structure of the estate.
🔹 Freehold Ownership
All properties in Old Domewood are freehold. Ownership includes a shared interest in the private road. No single body has overriding control of the estate, and owners are not leaseholders under a management company.
🔹 About DPRA Ltd
DPRA Ltd was established as a holding company for the road deeds, not as a statutory management company. It does not have automatic powers to impose charges, alter property ownership terms, or bind new purchasers unless agreed individually and lawfully.
🔹 Contributions to Road Maintenance
The courts have confirmed that only maintenance costs, as defined under the deeds present on some properties, are chargeable. Not all properties contain such clauses, and there is no general obligation to pay company-imposed charges beyond what is legally permitted under the individual property title.
🔹 Deed Changes and New Owners
Buyers should be aware that DPRA Ltd is planning to introduce revised deed wording and may ask new owners to sign updated terms. Freeholders are not bound by changes to their deed or property obligations unless they have personally agreed to them. The company does not have the legal authority to alter property ownership terms without the consent of each individual freeholder.
🔹 Note for Sellers
Sellers are advised to exercise caution. There has been at least one instance where payment was demanded during a sale despite the matter having already been dismissed by the court. Actions of this kind may place unnecessary pressure on sellers and their solicitors, and appear to disregard the court’s position.
